The Lazy Trader – Product Terms

Apprentice Trader: 

This elite level of membership is occasionally offered in collaboration with our preferred broker and grants free access to a pre-negotiated level of The Lazy Trader’s training facilities to “qualified clients”.

Details of the offer will be made available to prospective clients in advance of their training.  In order to qualify, prospective clients are required to fulfil “entry conditions” prior to receiving their complementary level of membership. This includes (but is not limited to) opening and funding an account with our selected broker. No additional fees will be required in exchange for the training, or access,  and the qualified client will be granted membership, pro-bono, in perpetuity.

This promotion is extremely limited and is subject to status. It is obtainable only to residents of the European Union, United Kingdom,  Canada, Australia, New Zealand, Singapore and South Africa.

Ultimate and Standard Membership: 

Lazy Trader Ultimate: You will have unlimited access to the members area for the sum of $252 (or advertised “offer” at time of purchase) and you will receive Ultimate premium services (all trade ideas and Market Insider reports/webinars) for $160 pcm until you specify otherwise.

The Lazy Trader Standard Membership: consists of a one-time-only payment of $494 and will grant you access all members’ services – for the lifetime of the product with the exception of: weekly webinars, trade signals, one-to-one coaching and other discretionary products.

You have the right to cancel your subscription to The Lazy Trader Ultimate subscription services providing 7 days notice are given in writing to: info (at) thelazytrader.com.

Cessation of your subscription will terminate access to trade idea and Market Insider reports – although The Lazy Trader will honour lifetime of unlimited access to the Member’s Area, will still be available providing you have been a subscribing member for at least three full calendar months (90 days).

Fair Use Policy

• Money-back Guarantee: All programmes we offer are covered by our money back guarantee in which you have 7 days to request a refund from the date of purchasing your one-off membership pass, providing you comply to our “fair use” policy: We will honour a full refund if the product falls short of expectations from the outset. We reserve the right to refuse a full refund if we see that the client has logged into the members’ portal in excess of 4 times within the 7 day trial period. Logging in more than 4 times to the members’ portal, and then simply asking for a full refund is not in the spirit on the product offering and gives a strong indication of abuse.
• Promotions: Occasionally, we offer time sensitive discounts for prospective clients. This is strictly limited to one offer per person (in their lifetime) and this cannot be transferred, exchanged or reused. Clients who have participated in any given offer and subsequently terminated the service or let payments lapse will be required to pay a full rate/standard fees if they decide to resume their membership at any given time.
• Chargebacks: We will always fight chargeback claims. All of the information relating to product fees is clearly visible at multiple stages throughout the purchase process, in addition to our 7-day satisfaction guarantee. The purchase of any Lazy Trader product is not possible unless the terms and conditions have been implicitly agreed to and accepted by the client prior to purchase (ie: without consenting to the terms & conditions, in addition to the associated charges, purchase will not be possible).We have all the essential buying information clearly visible to clients and we robustly defend any chargeback action where the client seeks to claim back the amount spent on the product with their credit card company, under the proviso of “unauthorized charge” or “product not as expected”. We deem this to be obtaining our services via deception – an outright abuse. In the event where a client makes a chargeback claim with their credit card company without contacting The Lazy Trader’s client services department for a resolution beforehand will be in clear breach of our terms and conditions and their actions interpreted as an abuse of service. Regardless of whether the disputed charge is awarded to by the credit card company the client or The Lazy Trader Ltd, we will still view this as an attempt to obtain “paid for” services via deception, and we shall still proactively seek to repatriate the amount owed to us. Any “chargeback” amount will be pursued by our chosen debt collection company, who will be employed to retrieve the aforementioned sum from the defaulting client, in addition to a $30 credit card admin fee (the fee we are obligated to pay by the credit card companies in the event of the said chargeback) in addition to a $50 admin fee (the time spent on unnecessary admin) per chargeback claim.

• The debtor will be liable for any additional legal fees incurred as a result of pursuing any payment which has gone over the standard payment terms.

Service Payments & Charges

The Lazy Trader (TheLazyTrader.com) is a division of The Lazy Trader Ltd and all payments will be collected (via PayPal) by this company. Charges include: a one-time membership fee of $252 (or advertised offer) plus a monthly rolling subscription of $160 (US Dollars) for receipt of trade signals and Market Scope. This monthly subscription will be debited once a month, on the anniversary of when you originally enrolled onto the program.

If we are unable to process payment at the point your monthly subscription falls due, your membership will be barred until we are successfully able to charge your card for the amount due. You will no longer have access to the members’ are or receive member services until the sum is paid. We will attempt to charge your card once a month on the anniversary date of when you originally enrolled onto the program, unless you specify you no longer wish to be a member by writing to us (info [at] thelazytrader [dot] com. If your card is successfully debited, your membership and full access rights will first be reinstated immediately.

‘Lifetime support’ and ‘unlimited access’ are both features which refer to the lifetime of The Lazy Trader Ultimate and will cease in the unlikely event the product it is withdrawn from the website.

Trade signals are only available to Ultimate clients and their frequency is random. Some months will have a higher total of trading opportunities than others – in extreme case, some months will have none. We will accept no liability whatsoever for the market conditions and the subsequent lack of opportunities at any given time.

In no event will you be charged for access to portions of the Service or to the Service as a whole unless TheLazyTrader.com/Westville Communications Ltd obtains your prior agreement to pay such charges. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including but not limited to charges for any products or services offered for sale through the Service by Thelazytrader.com or by any other vendor or service provider. All fees and charges shall be billed to you, and you shall be solely responsible for their payment. You acknowledge and agree to pay Thelazytrader.com reasonable attorney fees incurred in connection with any and all lawsuits brought against you by Thelazytrader.com under the TOS and any other terms and conditions of service on this site, including without limitation, lawsuits arising from your failure to indemnify Thelazytrader.com pursuant to the TOS.

8. Termination. (a) You may terminate the TOS, with or without cause and at any time, by discontinuing your use of the Service and destroying all materials obtained from the Service. (b) You agree that Thelazytrader.com, without notice, may terminate the TOS, or suspend your access to the Service, with or without cause at any time and effective immediately. The TOS will terminate immediately without notice from Thelazytrader.com if you, in Thelazytrader.com LLC’s sole discretion, fail to comply with any provision of the TOS. (c) Thelazytrader.com shall not be liable to you or any third party for the termination or suspension of the Service, or any claims related to the termination or suspension of the Service. Upon termination of the TOS by you or Thelazytrader.com, you must destroy promptly all materials obtained from the Service and any copies thereof.

9. Governing Law. The TOS shall be governed and construed in accordance with the laws of the United Kingdom, without giving effect to conflicts-of-law principles thereof.

10. Miscellaneous. You accept that Thelazytrader.com has the right to change the content or technical specifications of any aspect of the Service at any time at Thelazytrader.com sole discretion. You further accept that such changes may result in your being unable to access the Service. The failure of Thelazytrader.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. Sections 2 through 9, 10(c), and 11 through 17 shall survive any termination of the TOS.

12. Headings. The section titles in the TOS are used solely for the convenience of you and Thelazytrader.com and have no legal or contractual significance.

13. Severability. If any provision of the TOS is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of the TOS will remain in force.

14. Entire Agreement. The TOS and any other terms and conditions of service on this site, and its successor, constitute the entire agreement between you and Thelazytrader.com and govern your use of the Service.

15. The Lazy Trader Ltd and Thelazytrader.com is an accredited education/training provider (CPD Accredited), and is provided for informational, educational and/or training purposes only. The Lazy Trader Ltd and Thelazytrader.com do not carry out financially regulated activities (as defined by the FCA, ESMA or the SEC) and is therefore not currently regulated.
